Understanding terms and conditions is important. We also know that the legal stuff can sometimes be a bit boring and that you might not always “do the right thing” by reading them, so we’ve tried our best to keep them as informative and jargon-free as possible.
Below is a list of summaries which link to the relevant section, making it easier for you to search on the specifics. Remember, these terms and conditions are what you are agreeing to when you place an order with Proporta so it’s important that you do read them in full - ignorantia legis neminem excusat and all that.

Security & Privacy
Proporta is committed to your security and privacy. We promise to keep your personal information safe and secure. We'll make sure that no-one, other than yourself, can access your account or view your financial details. We also understand that junk mail can be really annoying so promise not to pass on your email address, home address or any other details to any third party other than eKomi our independent provider of reviews and feedback. Whom only details of the products ordered and the email address are passed.

Payment Terms
When you purchase a product from Proporta, the contract of sale only occurs when your goods are dispatched and your card is charged. We will NOT charge your credit card if for any reason we are unable to fulfil your order, including if the goods are not in stock. In a nutshell, your credit card will not be charged until your order has left the building.

Our Returns Policy
We know how irritating it can sometimes be when trying to return an item, and then being asked to pay for the postage. At Proporta, we try to make your experience as pain free as possible by offering a never-argue, Lifetime Exchange Warranty combined with free returns (sorry, this is UK & US only at the moment). We've even got the returns label for you to print off at www.proporta.co.uk/returns for UK returns and www.proporta.com/returns for returns from USA.

Policy on Personalised Cases
Personalised Cases: We regret that we cannot cancel orders once placed or offer refunds or replacements of personalised cases unless there is a fault with the product - in which case we will, as always, be happy to refund or replace according to your preference and our terms. Normally, we are happy to replace or refund a product if you change your mind but, once the case has been personalised, we cannot offer it for resale. Our Lifetime Warranty is not affected - if your personalised case (or any case) ever develops a fault, we will refund or replace it according to our Terms and Conditions.

When using our personalisation service, it is your responsibility to comply with any relevant laws and not to cause offence or harm to any person or organisation. You also agree not to supply by any means copyrighted material without the express permission of the copyright owner.

Proporta reserves the right to use any designs or text supplied by its customers for the purposes of promotion. Please contact us if you would like us to waive this right.

All personalised products will take 1-2 days to be dispatched than a standard product.

If no font is selected, the default font 'Noto Serif' will be used.

Promotion code/s for personalisation can be applied only on your next order with us. Please note that all your existing orders will be shipped with the confirmed order total. Please note: Some of the promotions we run, are not to be used in conjunction with any other offer including free shipping.

Lifetime Exchange Warranty
All Proporta* branded and BRUNSWICK ENGLAND hardware products come with a Lifetime Exchange Warranty. So if for any reason or no reason at all you are not completely satisfied, you can return the product to us and we'll exchange it for another one. In the event that the original product is no longer available, a best match alternative product of similar value will be offered. To register for your Lifetime Exchange Warranty, visit www.proporta.co.uk/warranty

Note: This excludes Proporta ninetysix, Proporta Smart, Proporta TurboChargers (and all of its contents) and the Proporta Pocket Power, which have a one year exchange warranty from the date of dispatch.

We can provide you with a full refund if a Proporta branded product is returned within 90 days from the date of dispatch.

Note: Due to PayPal refund policy, if your item is paid for with PayPal we can only accept returns within 60 days from date of purchase.

Proporta ninety-six
All Proporta ninety-six products come with a standard one year exchange warranty. However, you can upgrade to a FREE Lifetime Exchange Warranty by registering the details of your purchase with us here. You will be entitled to a refund if a Proporta ninety-six branded product is returned within 90 days from the date of dispatch.

Products with a One Year Exchange Warranty
All other products not explicitly included in the Lifetime Exchange Warranty section come with a one Year Exchange warranty as standard. This applies from the date of dispatch. This includes all Ted Baker, Barbour, Roxy, Quiksilver, Joules, Ben Allen, V&A, National Gallery, PhoGo, Lalita, Kenzo, NAF NAF, Morfica, Aquapac, Where's Wally, PhoGo and Freedom products. Products excluded from our Lifetime Exchange Warranty are listed here.

We’ll accept the return of these products for refunds, only if they’re returned to us within 30 days from the date we dispatched them to you. Provided you do this, we’ll be happy to a refund for the price that you paid for the item.

Non-Proporta Branded Products
We’ll accept the return of all non-Proporta branded products, but only if they’re returned to us within 30 days from the date we dispatched them to you. Provided you do this, we’ll be happy to arrange a refund for the price that you paid for the item.

Defective Products
Because we’re nice and are also delighted to say that this rarely happens, if you do find your Proporta product to be defective we’ll gladly provide you with an exchange or refund. Refund periods will vary according to the product brand. Please see ‘To return an item' below for details of how to return a defective item to us. The Proporta Lifetime Exchange Warranty applies only to Proporta branded products (excluding batteries or products that contain a battery and have a natural shelf-life). The Proporta money back guarantee covers the cost of your Proporta product only.


Device damage or data loss

Proporta cannot accept responsibility for the cost of your electronic device, or for the cost of any other products that you own – even where those devices are used with Proporta products. If you need any help, please contact us by email or give us a call.

Refunding Shipping Costs
UK customers can use our free Returns label. If you do not use these labels or are returning from outside the UK or USA, you are not entitled to a refund on shipping for your order, unless the reason for the return is the fault of Proporta, in which case we’ll refund the shipping in full (only valid for Standard Worldwide Delivery). For example, if the product that you are returning has no fault and the reason for the return is simply that you have changed your mind and is nothing to do with the quality of the product or service that you’ve received, we will not issue a refund. Shipping refunds will sometimes be considered at the discretion of the Customer Services department. We can’t make any promises though and each instance will be viewed on an individual basis.

Customs Information
When ordering goods from Proporta for delivery overseas, you may be subject to import duties and taxes (we know - pesky customs). Good news though - these are levied once the package reaches your country. Any additional charges for customs clearance however must be borne by you. We’re sorry, but we have no control over these and cannot predict what they may be. Customs policies vary widely from country to country, so try giving your local customs office a call for further information. Also, please note that when ordering from Proporta, you are considered the importer of record (owner/purchaser of goods) and therefore must comply with all laws and regulations of the country in which you are receiving the goods.

Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally, to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

Also, we may communicate information such as order, delivery and product details to our international carriers and such information may be communicated by the carriers to customs authorities. This is to facilitate customs clearance and comply with local laws.

If your order is a gift for a lucky someone, the package is marked "Gift". As with all companies, customs authorities require us to state the cost of the gift item directly on the customs form.

Settlement of disputes
These conditions of online sale are subject to English law.

In case of dispute, jurisdiction is given to the competent courts of London (UK), despite multiple defendants or warranty.

'Create your case' Terms and conditions

Users of the Proporta Create your case service expressly acknowledge and agree that the image submitted to Proporta is either owned by you or rightfully licensed to you for use and that such image submisson follows the terms and conditions of use of Proporta. You represent and warrant to Proporta that, in your use of the Proporta Create your case service, you: (i) will not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other legal right of any third party, and (ii) will comply with all applicable laws, rules, and regulations. You further represent and warrant to Proporta that: (i) there are no claims, demands or any form of litigation pending, or to the best of your knowledge, threatened with respect to any of your Content; (ii) Proporta will not be required to make any payments to any third party in connection with its use of your Content, except for the expenses that Proporta. incurs in providing the Proporta Create your case service; (iii) the use of any instructions, formulae, recommendations, or the like contained in your Content will not cause injury to any third party; and (iv) your Content does not contain viruses or any other programs or technology designed to disrupt or damage any software or hardware. All Images in the Collections belong to us. Rights are granted on a strictly one time, one edition, non-exclusive use, unless agreed otherwise in writing. Re-use of Images without written permission from us is forbidden.

Licence for Use of Images
The reproduction by whatever means of the whole or any part of any Collection Image (including, without limitation, slide projection, artist’s reference, artist’s illustration, layout or presentation of Images) is strictly forbidden without our specific written permission. You must inform us of your proposals as to when and how an Image is intended to be used. We will then consider whether we would wish to grant a licence and, if so, on what terms.
No reproduction rights are granted by virtue of delivery of Images unless expressly indicated. Your right to reproduce an Image arises only if licence terms are agreed. You must satisfy yourself that all necessary rights, model releases or consents which may be required for reproduction are obtained and that the use of any Image is not obscene, indecent, libellous or unlawful. We make no claim or warranty with regard to your use of content, names, text, people, trademarks or copyright material depicted in any Image and you will indemnify us in respect of any claims, damages, costs or expenses we incur arising from the use of any Image supplied to you.
Reproduction rights (if granted), unless otherwise agreed in writing are
(a) subject to these terms and conditions and any terms and conditions set out in the delivery note and licence,
(b) non-exclusive reproduction rights for single use only. A single use means a reproduction in one size for one edition of a single publication, published in one language only,
(c) strictly limited to the use, period of time and territory stated in the licence,
(d) personal to you and not assignable by you to any third party.
Collection Images shall not be altered or manipulated, added to, or have any part deleted without our prior written consent.
You must provide us on publication with at least one complimentary copy of any publication in which the reproduction of the Collection Image appears.

The content of the pages of the “Create a case” service is for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the pages of this service for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on the pages of this service is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this service meet your specific requirements.

This service contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

All trademarks reproduced in the pages of this service, which are not the property of, or licensed to the operator, are acknowledged on the website.

Unauthorised use of this service may give rise to a claim for damages and/or be a criminal offence.

Your use of the 'Create your case' service and any dispute arising out of such use of the service is subject to the laws of England, Northern Ireland, Scotland and Wales.
